Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, platforms, and services operated by ConfidTherapy LTD (“we”, “us”, “our”), including:

• ConfidTherapy — practice management software for UK-registered therapists
• ConfidResearch — clinical research infrastructure for mental health researchers
• Our website at confidtherapy.co.uk and associated subdomains

Please read these Terms carefully. If you do not agree to them, you must not use our services.

1. About Us

ConfidTherapy LTD is a company registered in England and Wales (Company No. 17179796) with registered address at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ. You can contact us at info@confidtherapy.co.uk.

2. Eligibility

You must be at least 18 years old to use our services. By using our services you confirm that you meet this requirement.

ConfidTherapy is designed for use by registered therapists and counsellors in the United Kingdom. ConfidResearch is designed for use by researchers, PhD students, and clinicians working in mental health. We reserve the right to decline or remove access where we have reason to believe a user does not meet these criteria.

3. Early Access and Register-Interest Programme

During our pre-launch phase:

• Access to the platforms is granted by invitation only and may be revoked at our discretion
• Features may be incomplete, subject to change, or temporarily unavailable
• Early access is provided free of charge; we reserve the right to introduce paid plans on commercial launch
• Early access members will be given advance notice of any pricing changes and, where possible, preferential terms

4. Acceptable Use

You agree that you will not use our services to:

• Violate any applicable law or regulation, including UK GDPR and the Data Protection Act 2018
• Upload, store, or process personal data without appropriate consent from data subjects
• Attempt to gain unauthorised access to any part of our systems or another user’s account
• Reverse engineer, copy, or reproduce any part of our software or intellectual property
• Use the service to store clinical records for clients without first reviewing your own professional obligations under your accrediting body (BACP, UKCP, BPS, HCPC, etc.)
• Transmit spam, malware, or any content that is harmful, defamatory, or unlawful

5. Clinical and Professional Responsibility

ConfidTherapy and ConfidResearch are tools to support your professional practice. They do not replace your professional judgement or obligations as a registered therapist or researcher.

• You remain solely responsible for the clinical decisions you make and the records you keep
• You are responsible for ensuring your use of our platforms complies with your accrediting body’s requirements
• For research use: you are responsible for obtaining appropriate ethical approvals (HRA, institutional ethics committees) before using ConfidResearch to collect participant data
• ConfidTherapy LTD does not provide clinical supervision, legal advice, or professional indemnity

6. Data and Privacy

Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms.

Where you use ConfidTherapy or ConfidResearch to process personal data belonging to your clients or research participants, you do so as a data controller in your own right. You are responsible for ensuring that your data processing meets UK GDPR requirements, including obtaining appropriate consent and providing privacy notices to those individuals.

We act as a data processor on your behalf in relation to client and participant data. We will process such data only in accordance with your instructions and our Data Processing Agreement (available on request).

7. Intellectual Property

All intellectual property in our platforms, including software, design, content, and trademarks, belongs to ConfidTherapy LTD. Nothing in these Terms transfers any intellectual property rights to you.

You retain ownership of the data you input into our platforms (session notes, client records, research data). We do not claim ownership of your content.

8. Availability and Uptime

We will make reasonable efforts to keep our services available. During the early access period, we do not provide any guaranteed uptime or service level agreement. We may carry out maintenance, updates, or modifications at any time, with or without notice.

9. Limitation of Liability

To the fullest extent permitted by law:

• Our total liability to you for any claim arising from use of our services will not exceed the amount paid by you to us in the 12 months preceding the claim (or £100 where no payment has been made)
• We will not be liable for loss of data, loss of revenue, loss of profits, or any indirect or consequential loss
• We do not exclude liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation

Nothing in these Terms affects your statutory rights as a consumer under English law.

10. Termination

We may suspend or terminate your access to our services at any time if you breach these Terms, or for any other reason with reasonable notice. You may request deletion of your account and data at any time by emailing info@confidtherapy.co.uk.

On termination, we will make your data available for export for a period of 30 days, after which it will be securely deleted.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of our services after the effective date constitutes acceptance of the updated Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of England and Wales. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.

We encourage you to contact us in the first instance to resolve any dispute informally.
